« Point de Contact », the French on line reporting service created by the French Internet Service Providers Association (AFA) in 1998, became, after the signing of the « Charteragainst odious content » of June 14 2004¹, the relay of the legal² obligation that lies with Internet access and hosting providers members of AFA:
- to provide their users with a mechanism allowing them to report certain types of illegal content,
- to inform the competent authorities of these illegal activities,
- to make public the means dedicated to the fight against these illegal activities.
Therefore, when a technical intermediary sets up a hyperlink towardsthe www.pointdecontact.net reporting form for potentially illegal content, in order to meet its legal obligation under the Law on Confidence in the Digital Economy (LCEN), it becomes subject to AFA membership.
Similarly, when a technical intermediary, which isn't subject to the LCEN, sets up a hyperlink towards www.pointdecontact.net in order to provide its users with a service for reporting illegal content, it becomes subject to AFA membership.
